By using Kadaza ("Kadaza" or "Kadaza.co.za" or “Website” or "site"), you agree to abide and be bound by these Terms of Service and/or any revised version. Since this is a website in progress with continual additions and expansions, and because Internet technologies are constantly evolving, these Terms are subject to change. By using Kadaza, you agree to abide and bound by these Terms of Service, which may be modified or updated from time to time. We encourage you to regularly review these terms of service. To use Kadaza, you must be legally competent to enter a binding agreement. Kadaza is not responsible for the content or the privacy policies of websites to which it may link.

1. Description of Service

Kadaza provides its users, for a non-commercial personal use, a directory of sites and a customizable start page enabling you to select and aggregate links, visualized by logos. The use of the Service is free. Each time you access Kadaza on your computer, the latest version of your personalized Kadaza start page will be displayed as all modifications made to your page are saved in real time.

3. Terms of Use

3.1 User agrees to use the Website only for purposes that are permitted by a) the Terms and b) any applicable law, regulation, or generally accepted practices in the relevant jurisdiction.

3.2 You must be at least 13 years or older to use Kadaza.

3.3 Users are the sole persons responsible for online conduct, the links and sites they choose to add to their start page and any derived content and information thereof. The choice of sites added to the personalized Kadaza feature is entirely up to the user, and Kadaza shall not be responsible or held accountable for any inappropriate content as a result.

3.4 Making changes to, adapting, hacking or making use of the Kadaza service for any purpose or reason other than those described in this document or anywhere else on the website, including any false representation of Kadaza and/or association with Kadaza is strictly forbidden.

3.5 You understand and agree that by adding a site to your Kadaza personalized home page you do not own, neither entirely nor partially, or maintain any copyright of the chosen site's trademark.

3.6 You understand and agree that by selecting a background for your Kadaza personalized home page you do not own, neither entirely nor partially, or maintain any copyright of the chosen background. You are not allowed to copy, reproduce, make available online to the public, sell or reuse the backgrounds or part of the backgrounds in any way without the permission of the rights holder.

3.7 You agree not to post, share, or otherwise transmit any content that is unlawful, obscene, harmful, threatening or hateful or that contains objects or symbols of hate, invades the privacy of any third party, or is otherwise objectionable.

3.8 You agree to respect the privacy of others and the confidentiality of the information you may receive and not to post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, “chain letters” or any other form of solicitation.

3.9 You agree not to harass any other user of the site or to impersonate another user by any means.

3.10 You agree to always provide truthful, sincere and actual personal data and information and to update said data and information as needed so that they remain true, complete, accurate, and current.

3.11 You agree to respect the rights of others and, more generally, all applicable laws and regulations relevant to your use of Kadaza, and not to make available any content that you do not have the lawful right to submit, that would infringe the intellectual or proprietary rights of any third party, or that would violate the right of privacy or publicity of any public or non public persons.

3.12 You agree not to engage in any conduct or to post or share any content that would interrupt, destroy, limit or more generally harm the site and/or the service or enable you to gain unauthorized access to the site, including by using viruses, malicious computer code, programs or files.

In case of any violation of the above, Kadaza reserves the right to block you from accessing the site as well as to disclose any information as necessary to satisfy any law, regulation, governmental request or partner request, at its sole discretion.

4. Copyright

You acknowledge and agree that the content on Kadaza and its design, structure and compilation are protected by copyrights, trademarks, service marks, and patents or other proprietary rights and laws. It is very easy to copy things in cyberspace, but not necessarily always acceptable or legal. The registered Kadaza trademark and logo and all other Kadaza trademarks are owned by Kadaza and are protected by copyright and intellectual property laws in the United States and other countries as well as by international treaties. You agree not to use or communicate said trademarks or logo without our written consent. However, and by exception, you may reproduce the Kadaza logo on your website in order to link to Kadaza or use it in an article about Kadaza.

5. Intellectual Property of Others

We respect the intellectual property of others. If you believe that material over which you have rights has been reproduced or used in such a way as to constitute an infringement, please contact us with your personal information, a description of your work, the location on the Site of the potentially infringing material, a statement of the rights you have asserted over the work, and a statement of the absence of authorization given to the party using said material.

6. Licensing

The logos and images that appear on Kadaza are of a company, organization, item, product or event, and are protected by copyrights, trademarks, service marks, and patents or other proprietary rights and laws. It is believed that the use of low-resolution images of logos (1) to illustrate the Company, organization, item, product or event in question and/or (2) to use a visual link directly to the Company, organization, item, or event associated with the respective links/logo qualifies as fair use under Copyright Law.

Any featured companies, organizations, items or events on the Kadaza website that wish to be removed from Kadaza, may contact us at info@kadaza.co.za and we shall remove these upon request.

7. Links to other sites & Ads

We provide links to other internet sites or resources. We do not control these sites and resources, do not endorse them, and are not responsible for any aspects of those sites, including their availability, content, accuracy, legality or delivery of services. You waive any claim resulting from your exposure to material on or through Kadaza that is offensive, indecent, or otherwise objectionable. Kadaza is not responsible for the content or the privacy policies of websites to which it may link.

The advertisements, including graphic design, typography, portraits and logos, as well as trademarks, servicemarks and tradenames are the intellectual property of their rights holders, such as the advertisers and/or third parties. You are not allowed to copy, reproduce, make available online to the public, sell or reuse the advertisements or part of the advertisements in any way without the permission of the rights holder. Kadaza is not responsible or liable for the contents of advertisements, in-ad links to advertisers or third party websites or the contents, products or services offered on advertisers or third party websites. You accept that all use outside the website is at your own risk.

8. Notices

We may display links on the Site to notices. We may use this method, for instance, to inform you of future revisions to the terms of service. You can also subscribe to the Kadaza newsletter. We'll sporadically send you updates of current and future Kadaza features. Should you decide to discontinue the sending of our newsletter, you are welcome to unsubscribe. We will never share your contact information with third parties. Please be aware that we may provide your personal information if we are required to do so by law or compelled by a court of law. In case of any violation of our Terms of Service, Kadaza reserves the right to block you from accessing the site as well as to disclose any information as necessary to satisfy any law, regulation, governmental request or partner request, at its sole discretion.

KADAZA PROVIDES ITS SERVICE “AS-IS”, WITHOUT WARRANTY OF ANY KIND. WE MAKE NO REPRESENTATIONS AS TO THE ACCURACY, QUALITY, TIMELINESS, AVAILABILITY, OR COMPLETENESS OF THE INFORMATION, SOFTWARE, PRODUCTS, OR OTHER MATERIAL AVAILABLE THROUGH KADAZA, AND YOU SHOULD NOT RELY UPON THEM. YOU USE KADAZA AT YOUR OWN RISK, AND KADAZA, ITS EMPLOYEES, DIRECTORS AND CONTRIBUTORS ARE NOT LIABLE FOR ANY ERRORS OR OMISSIONS IN ITS CONTENT OR DELIVERY, OR FOR ANY FORM OF LOSS OR DAMAGE (INCLUDING ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, OR EXEMPLARY DAMAGES, EVEN IF KNOWN TO US) THAT MAY RESULT FROM ITS USE. These rights and obligations arising out of or in connection to these Terms shall be construed, governed, Interpreted and enforced according to the laws of the Netherlands. The exclusive jurisdiction and venue of any action with respect to any subject matter relating to these Terms will be the courts located in Amsterdam, the Netherlands, unless stipulated otherwise by mandatory Dutch or international laws. You waive any objection to jurisdiction and venue in the courts of the Netherlands.

11. Stop using Kadaza

Kadaza is a website which can be set as a homepage in your browser, meaning you can also remove it fairly easy. Kadaza won't change your homepage settings without your permission. If you do not wish to use Kadaza, or simply do not want Kadaza as your browser's start page, you can change your desired homepage within your browser's settings.
